These Terms of Use set the rules for using the Becoming Institute website and our online portals. By using them, you agree to these terms.
- What they cover: becominginstitute.ca, the self-referral portal (selfrefer.becominginstitute.ca) and the Partner Connect portal (partnerconnect.becominginstitute.ca).
- Not an emergency service: our website and portals are not monitored around the clock. If you are in immediate danger, call 911 or go to your nearest emergency department.
- Your information: how we handle personal and health information is explained in our Mindful Fitness Privacy Policy.
- Your care: once you begin services, your care is also governed by the consent and service agreements you sign with us in Jane, our clinical records system.
- Be accurate and respectful: give accurate information, keep your login secure, and use our services only for their intended purpose.
1. About these terms
These Terms of Use (“Terms”) are an agreement between you and Becoming Institute Inc. (“we,” “us,” “our”). They apply when you visit or use:
- our website at becominginstitute.ca;
- the self-referral portal at selfrefer.becominginstitute.ca; and
- the Partner Connect portal at partnerconnect.becominginstitute.ca.
Together, these are our “Sites.” By using the Sites, or by creating an account, you agree to these Terms. If you do not agree, please do not use the Sites.
Other agreements. If you receive clinical services from us, the consent forms, confidentiality terms and service agreements you complete in Jane also apply to your care. If those documents and these Terms differ on a matter of clinical care, the Jane documents apply. Courses and training programs may have their own enrolment terms.
2. Not an emergency service
Our Sites, referral portals, email and care line are not monitored 24 hours a day and must not be used for emergencies. Our care team contacts applicants within 3 business days.
If you are in immediate danger or cannot stay safe, call 911 or go to your nearest emergency department. You can also call or text 9-8-8, Canada’s suicide crisis helpline, at any time.
3. Information on our website is not medical advice
Content on our website, including articles, blog posts, videos and resources, is for general education and information. It is not a diagnosis, treatment or a substitute for care from a qualified health professional. Using our website or submitting a referral does not by itself create a clinician–client relationship. That relationship begins only when our care team confirms your participation and you complete our consent process.
4. Who can use the referral portals
Self-referral portal. The Mindful Fitness program is open to adults 18 years of age or older who live in our service area: Peel Region, the Greater Toronto Area, Simcoe County, Durham Region and Halton Region. You must be 18 or older to create a self-referral account. Submitting a referral does not guarantee admission to the program. Our care team reviews each referral for eligibility and safety and may recommend other services where the program is not the right fit.
Partner Connect portal. Partner Connect is for community organizations and health care professionals referring clients to our programs. By creating a Partner Connect account, you confirm that you are authorized to make referrals on behalf of your organization or practice.
5. Your account
When you create an account on either portal, you agree to:
- provide accurate, current and complete information, and update it when it changes;
- keep your password private and not share your account with anyone;
- tell us right away at privacy@becominginstitute.ca if you believe someone has used your account without permission; and
- use the account only for yourself or, for Partner Connect, only for your authorized referral work.
You are responsible for activity under your account unless it results from our failure to protect it. You may ask us to close your account at any time. Information that has become part of a clinical record is kept as described in our Privacy Policy.
6. Rules for referring partners
If you use Partner Connect, you agree to:
- refer a person only with that person’s knowledge and agreement;
- share only the information needed for the referral, and make sure it is accurate to the best of your knowledge;
- follow the privacy laws and professional standards that apply to you and your organization;
- not submit referrals for anyone under 18 or outside our service area; and
- understand that we will contact the referred person directly to confirm their interest, and that we will share updates with you only with that person’s consent.
7. Acceptable use
When using our Sites, you agree not to:
- submit false, misleading or someone else’s information, or impersonate another person;
- access, or try to access, another person’s account or information;
- interfere with the security or operation of the Sites, including by introducing viruses or malicious code, or by testing or bypassing security features;
- use automated tools to copy or collect content or information from the Sites;
- post or send content that is threatening, harassing, discriminatory, hateful or unlawful; or
- use the Sites for advertising, solicitation or any purpose other than their intended use.
We may suspend or close an account, or refuse a referral submitted through it, if these Terms are not followed. Where a referral involves a safety concern, we will still respond appropriately.
8. Messages from us
If you choose to receive text messages or emails, we use them only for service-related purposes such as referral confirmations, next steps and appointment reminders, never for marketing. Reply STOP to any text to stop texts, or HELP for help. Email and text messages are not fully secure, so please do not send detailed health information by email or text. Details are in our Privacy Policy.
9. Privacy
Our Mindful Fitness Privacy Policy explains how we collect, use, share, store and protect personal and personal health information, and your rights. It forms part of these Terms.
10. Our content and intellectual property
The content on our Sites, including text, program names, curricula, course and program materials, worksheets, videos, graphics, logos and the Becoming Institute and Mindful Fitness names, belongs to Becoming Institute Inc. or is used with permission. It is protected by Canadian copyright and trademark law.
You may view and print content for your own personal, non-commercial use. You may not copy, reproduce, sell, distribute, adapt or publish our content or program materials without our written permission.
11. Links to other websites
Our Sites may link to other websites and services, such as crisis lines, community resources or Jane. We do not control those websites and are not responsible for their content or privacy practices. Please review their terms and privacy policies.
12. Availability of the Sites
We work to keep our Sites available, accurate and secure, but we cannot promise that they will always be available, error-free or uninterrupted. We may update, change or temporarily suspend the Sites, including for maintenance or security reasons.
13. Limitation of liability
To the extent permitted by law, the Sites are provided “as is,” and Becoming Institute Inc. is not responsible for indirect or consequential losses arising from your use of, or inability to use, the Sites, including losses caused by service interruptions or by websites we link to. Nothing in these Terms limits any responsibility we have under the law that cannot be limited, including our obligations as a health information custodian under PHIPA and our professional obligations to our clients.
14. Changes to these terms
We may update these Terms from time to time. We will post the updated Terms on this page with a new “last updated” date. If you continue to use the Sites after the changes take effect, you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there.
